Damages | Detailed Account of Injuries
The harms suffered by a typical personal injury plaintiff fall into two categories called economic and non-economic damages.
Non-Economic Damages
Non-Economic Damages include physical pain, mental suffering, loss of enjoyment of life, disfigurement, physical impairment, inconvenience, grief, anxiety, humiliation, and emotional distress. No fixed standard exists for deciding the amount of compensation awarded for these non-economic damages. Compensation is decided using good judgment and common sense based on the evidence presented. That is why it is good practice to keep a detailed account of what you have endured because of the injuries negligently inflicted upon you.
Pain and Suffering: A victim will want to write down what type of pain they endured, where they endured it, for how long they endured it, and what they did to attempt to alleviate the pain.
Example Scenario 1: May 1, 2016 – Its been 3-weeks since my car crash. My back still hurts. I saw the doctor yesterday and I was prescribed physical therapy. I continue taking my pain killers 2-times a day because the pain in my low back becomes unbearable. My pain starts in my low back and increases to the point that I need to take my medicine. This pain last for 2-3 hours before it goes away then starts up again towards the end of the day.
Loss of Enjoyment: A victim will want to write down what personal events or life activities they missed out on because of their injuries
Example Scenario 2: May 10, 2016 – Its been over 4-weeks since my car crash. My back still hurts. Today I was not able to attend my nephew’s law school graduation. I am too uncomfortable walking and sitting for long periods of time.
There is usually a lengthy time period between the day of the injury producing incident and resolution. Time heals many wounds and erases what were initial griefs and disappointments. You will be able to express these initial pains and suffering but not if you forget about them.
