Motorcycle Accident | California Law
California motorist must look carefully for motorcyclist in their blind spots before turning left or right, or merging onto another lane. Drivers must scan their surroundings looking for motorcyclist by using their mirrors and looking over their shoulder. They must know what is behind them before making any safe vehicle movements. A driver’s failure to use reasonable care when sharing the road with a motorcyclist is negligence.
Motorcycle Accident | Standard of Care
A California motorist is encouraged to follow these rules in order to respect the right-of-way of a motorcyclist, and safely share the road with them:
Changing Lanes: When changing lanes or entering an intersection, a motorist should make a visual check for motorcycles;
Following Distance: A motorist should allow a 4-second following distance when behind a motorcyclist. Four seconds is the approximate time needed to avoid hitting a motorcyclist if they suddenly brake;
Lane Width: A motorist should allow a motorcycle a full lane width between them (it is not against the law to share a lane with a motorcycle but it is just not safe according to the DMV;
Passing: A motorist should never attempt to pass a motorcycle in the same lane they are sharing; and
Turn: When making a turn, a motorist should check for motorcycles and gauge their speed before turning.
