Personal injury lawsuits are generally based on a claim of negligence.  Negligence is the failure to use reasonable care to prevent harm to oneself or to others. A person can be negligent by acting or failing to act.

The elements of a cause of action for negligence are well established and include the following:

  • A legal duty to use reasonable care;
  • A breach of the duty to use reasonable care; and
  • A breach of the duty to use reasonable care which resulted in economic and/or non-economic damages/injuries suffered by the plaintiff.

Example Scenario 1: Joe is driving his car westbound on Broadway near the intersection with 24th Avenue in Golden Hill. He has a legal duty to use reasonable care while driving. Joe though, fails to stop for a red light as he crosses the intersection and t-bones Julia who was driving southbound on 24th Ave.  As a result, Julia suffered a broken pelvis and missed 8-weeks of work. Joe is liable for the lost wages (economic damages) incurred by Julia as well as her pain and suffering (non-economic) damages.

Negligence suits typically arise from a California state claim and are filed in state court but in some instances the nature of the injury producing event requires that the lawsuit be filed in federal court. Aviation Accidents occurring on international flights are one example in which suit needs to be filed in federal court.
